Anita's Claim

Anita brought an action for clinical negligence on behalf of her late husband's estate against his General Practitioner, who, it was contended, failed to make the diagnosis of angina at a consultation 9 months prior to his fatal heart attack.

Anita's case was that her husband should have been referred to a cardiologist and/or told to seek urgent medical attention if his symptoms worsened or came on at rest. It was argued that had her husband been referred appropriately, he would have had a heart bypass operation and a 60% chance of living 14 years with a good lifestyle.

After negotiations, the defendants increased their settlement offer to £65,000, which was accepted by the claimant. When the judge approved the Consent Order he commented that had the case been tried and been successful, his assessment of quantum would have been about the same as the settlement.
